Assault charge dropped for pol

A POLICE officer accused of pointing his gun at a female colleague had assault charges against him dismissed yesterday, after a magistrate found there was no evidence to support the alleged victim's claims.

Senior Constable Phillip John Maria allegedly trained his pistol on the chest of the woman "as a joke" at Terrigal police station north of Sydney in July 2004.
Despite the policewoman giving evidence that the incident occurred in front of two other officers, those men denied seeing Maria aim the gun at her chest.

The officers instead said the gun was pointed either towards the floor or a wall of the room.

At Downing Centre Local Court, Magistrate Antony Townsden dismissed the charge, ruling the evidence was "so lacking" that no tribunal could rely on it.

Despite finding the policewoman to be "credible", Mr Townsden said he dismissed the charge because her version of events was not supported by other officers.

"There's nothing to suggest she's lying, nothing to suggest it was concocted or fictitious or that she would invent this story," he said.

"I found her to be a credible witness.

"Similarly, there's nothing before me to suggest that the other officers concocted or conspired to negate that evidence. No matter how much this case might smell, I can't draw the conclusion that there's been a conspiracy"
