WARREN — Among the laundry list of charges Patrolman Richard Kovach faces for repeatedly using a Taser on an intoxicated woman is inhumane treatment.

Police shootout that left 2 de

The officers who were involved in a Humboldt Park shooting Monday afternoon that left two alleged gang members dead and another critically injured were justified in their actions, a Chicago police roundtable determined Tuesday.

But the families of Marcus Thomas, 21, and William "J.T." Tyler, 23, called their deaths senseless and urged officials to release further details of the incident.

Police have declined to talk in depth about what they say is a continuing, weekslong investigation into gang activity in the Harrison and Monroe Districts.

"At this point in the investigation, without divulging too many details, the discharge of weapons by officers was well within the guidelines and in compliance of department policy," said Monique Bond, police spokeswoman. "More than a dozen witnesses corroborated police accounts."

Police were following a Pontiac Grand Prix containing three suspected members of the New Breed gang when they pulled the vehicle over about 3:45 p.m. on Augusta Boulevard near Kedzie Avenue, according to officials.

Police said the men were on their way to kill a rival gang member and were suspected in multiple gang-related homicides.

As they approached, police saw the man in the back seat raise an AK-47 assault rifle toward them, and officers fired, killing that man and the driver, according to Police Supt. Philip Cline.

The third man remains in Mt. Sinai Hospital in critical condition but is expected to survive, Bond said. Charges are pending against him, she said.

An officer who was shot in the hand, a veteran of 14 years, was released Tuesday from the hospital after his middle right finger was amputated, she said.

Bond declined to say why police opted to confront the men at that intersection, in a mostly residential neighborhood. Humboldt Park lies on the northeast corner of the intersection, while the opposite corner houses a large brick factory.

Bond said police knew that a school bus being driven near the shooting, contained no children.

Bond would not say if police had issued warrants for the arrest of the suspects, a point that outraged the Marcus Thomas family.

"If they were responsible for multiple murders, shouldn't there be a time when you have a warrant for their arrest?" asked Davin Worlds, 45, Thomas' father.

Worlds said he did not know if his son was a New Breed gang member but added that regardless of his gang status, police should have handled the situation in a manner that did not lead to violence.

Court records indicate Thomas, of the 3400 block of West Douglas Boulevard, has twice been convicted of drug-related charges. Tyler, of the 100 block of North Leclaire Avenue, pleaded guilty to a drug charge in 2004 and received 24 months of probation.
