Policeman fined over data

A FORMER Commonwealth policeman who incited a Victorian cop to obtain information from the confidential police LEAP database has been fined $4500.


Kerry Leon Milte, 62, was today sentenced in the County Court on three counts of inciting his friend, police constable Norman Bruce Dunn, 35, to provide police information between November, 2002, and October, 2003.

Judge Susan Cohen imposed a conviction on Milte. Dunn was also fined $3000 without conviction.


The County Court heard that the information was sought at the request of a union official and the wife of federal MP Bob Sercombe.


Judge Cohen said Milte had abused the trust placed in him, as well as his friendship with Dunn.


"These offences undermine the public confidence in law enforcement in this state,'' Judge Cohen said.


She said the integrity of the LEAP database was vital to the continued flow of information to police and for the safety of those who might be put at risk if their information falls into the wrong hands.
In November, 2002, Carmen Sercombe asked Milte to track down a debtor of an acquiantance.

Milte asked Dunn to do a check and he provided information on the alleged debtor's name, address and prior convictions.


Judge Cohen said Dunn also asked a police unit to visit the house to ensure the person still lived there.


In October, 2003, Milte asked Dunn to attend a meeting with two people he claimed were from Toyota. One of them was a union official with the vehicle division of the AMWU, Ian Jones.


Judge Cohen said Dunn was asked to conduct a check on a Toyota shop steward.
She said one of the reasons given to the court for the check was that it would be used in a attempt to defeat "some troublemakers'' in a union election.


Dunn conducted the LEAP check and found the shop steward had no prior convictions. He also did a check on people who lived at the same address.


The court heard that Dunn was overawed by Milte and that he provided the information in the hope that Milte would be able to advance his career.


Milte claims to have been a consultant to Victoria Police. But Chief Commissioner Christine Nixon claims Milte was never paid and he only provided information.
