Three police officers re-charg

KOTA TINGGI: Three police officers were re-charged in a Sessions court here for corruptly soliciting a RM300 bribe in 2004 after the witness in the case was located in prison.

Although the three accused had been arrested three years ago, they had been released under a discharge not amounting to an acquittal in Sept last year when the prosecution could not bring forth the witness.

Upon location of the witness at the Kajang prison, L/Kpl Sahardin Nalam, 51, L/Kpl Noor Azman Ali, 40 and Kons Sharol Ixuan Salleh (sic), 24, who were attached at the Endau police station, found themselves back in court again.

The three men were charged for corruptly soliciting a RM300 bribe from a former settler Che Ali Jusoh on Feb 2 in 2004 at around 12pm in Pekan Endau as an inducement to forbear the fact that Che Ali did not have a driving license and was found with a tube of straw believed to contain heroin.

All three men claimed trial and Judge K.K. Nair fixed bail at RM3,000 each, refusing L/Kpl Sahardin's request for the bail to be reduced.

They were charged under Section 10 (a) (bb) of the Anti-Corruption Act 1997 (Act 575) for corruptly soliciting gratification.

The act is to be read together with Section 24 of the Penal Code (Act 574) for dishonestly causing wrongful gain to one person and wrongful loss to another person.

L/Kpl Noor Azman was further charged for a second offence of accepting a RM300 bribe from Che Ali on Feb 7 in 2004 at around 2.05pm by the side of the Endau bridge in Mersing in connection with the same case.

The charge was under Section 11 (a) of the Anti-Corruption Act 1997 for accepting gratification.

He was ordered to pay an additional RM3,000 bail for that offence.

Both cases were fixed for trial on April 11.

Anti-Corruption Agency (ACA) prosecuting officer Sheikh Hamadi Sheikh Abdul Hamid prosecuted.
