2 Mount Vernon police officers

MOUNT VERNON - Two city police officers participated in drag race that ended with a crash and an injury, authorities said.

Leonard Cooper, 26, and Robert Burke, 25, pleaded guilty yesterday to reckless driving, a misdemeanor. Burke also pleaded guilty to third-degree assault, a misdemeanor, in connection with the April 1 race, Westchester District Attorney Janet DiFiore and Mount Vernon Police Commissioner David Chong said.

The officers also face possible disciplinary action from their department, which is weighing administrative charges against them. Charges are also being weighed against five officers and two civilian employees of the Police Department, regarding the investigation of the incident.

"The others weren't involved in the race," Police Chief Joseph Pizzutti said. "We're simply looking to see whether they followed all police procedures properly."

The two officers raced each other, driving more than 65 mph - more than twice the limit - in a "speed contest" about 6 a.m. on North Macquesten Parkway in Mount Vernon, authorities said. They drove on the wrong side of the road, over the double yellow line.

Burke, operating a 1990 Ford Mustang with one passenger, lost control and crashed, injuring his passenger - an off-duty state trooper who suffered a hairline fracture of a vertebra.

Cooper and Burke were arraigned yesterday in Mount Vernon City Court and pleaded guilty as charged.

Assistant District Attorney Michael Hughes, chief of the public integrity bureau, prosecuted the case.

Pizzutti said Cooper and Burke were confined to desk jobs for several months following the incident but since have been allowed to resume regular duties.

"The charges they pleaded guilty to are relatively minor, compared to many other things that people do wrong," Pizzutti said, though he noted they and the other employees still could be punished further as a result of the pending disciplinary hearings.

At the time of the crash, there were concerns that the investigating officer, Thomas Bendo, apparently did not give Burke a sobriety test. He also did not impound the car, which police said was uninsured and not registered.
