Detective resigns on day of he

A DETECTIVE facing internal disciplinary charges for allegedly lying during Office of Police Integrity hearings has resigned on the day his case was to be heard by one of Victoria's most senior police.

And two others produced medical certificates stating they were unfit to appear before Deputy Commissioner Kieran Walshe at last week's hearings.

Four members from the now disbanded armed offenders squad were suspended and charged with the disciplinary offence of improper conduct after they gave sworn evidence at an OPI hearing denying claims that a suspect had been assaulted in a police interview room — unaware that the alleged bashing had been secretly filmed.

The OPI yesterday told The Age that after discussions with the Office of Public Prosecutions, the four will also be charged with criminal offences.

Deputy Director Graham Ashton said: "Merely because a police officer resigns does not put him beyond the reach of the OPI. Our intention to prosecute in this case is not affected by any resignation."

Detective Senior Constable Mark Butterfield resigned on Monday, just before his internal hearing. Mr Walshe had the power to recommended he be sacked, but as he has now officially left the force, the discipline charge lapses.

Detective Sergeant Matthew Franc produced a doctor's certificate before his hearing and it has been adjourned for two months. Detective Senior Constable Robert Dabb's hearing has been adjourned for a month after he was found to be too ill to appear.

The hearing for Detective Senior Constable Darren Paxton has been delayed for three weeks on "administrative grounds".

A police spokeswoman confirmed that one of the suspended police had resigned and that the three remaining cases " will be dealt with in due course".

Mr Ashton said: "We are still compiling the briefs of evidence but after discussions with the OPP they will be charged with criminal offences." It is believed the charges will be assault and offences relating to sworn evidence given in the OPI hearings.

The Armed Offenders Squad was disbanded last August after claims were made that several of the 35-strong squad were assaulting suspects during interrogations.

Police Association secretary Paul Mullet told The Age when the four police were charged in December that he believed it was an abuse of process for the detectives to be facing disciplinary offences while still facing criminal investigations over assault and perjury allegations.
