Flat Rock police chief suspend

A veteran Flat Rock police officer charged in federal court with being addicted to or involved with the distribution of prescription medications has been suspended, effective immediately.

David DeWitt, a 14-veteran of the force, was suspended without pay after he met Wednesday morning with Flat Rock police Chief Stephen Tallman.

"This is my call," the chief said. "These are very serious charges."

Officer DeWitt, 37, who served as acting sergeant for two years, was arraigned in federal court in Detroit on Tuesday on charges of illegally possessing a controlled substance with intent to deliver, illegally possessing a firearm with being an addict or drug abuser and possessing a firearm while trafficking drugs.

The 15-page affidavit filed in U.S. District Court accused the officer of obtaining large quantities of prescription drugs, including the painkiller Oxycontin. The FBI claims Officer DeWitt received numerous painkillers and muscle relaxants between 2003 and 2005 from an osteopath, who also has been under investigation by the FBI and the Drug Enforcement Agency.

The affidavit claims Officer DeWitt either was involved with distributing the drugs or was addicted to them while he was on the force and carrying a weapon, which is illegal.

The affidavit also claims Officer DeWitt purposely did not disclose in medical documents that he was a police officer and that he was filling prescriptions for 150 tablets of Ocycontin a month, in addition to other drugs.

"Based on the quantity of drugs he had filled," the affidavit states, "DeWitt would have been taking five tablets of Oxycontin per day, every day, indicating DeWitt ingested the controlled substance while conducting work for the Flat Rock Police Department."

The court document states that Officer DeWitt either had a very serious drug addiction, was illegally distributing the drugs or both.

"It was clear he was addicted to these drugs," while being an active police officer - who was armed while on duty - and that is a violation of federal law, according to the sworn statement filed in federal court. "It is possible that he likewise distributed a controlled substance while possessing his firearm."

Officer DeWitt, who had been on medical leave before his suspension, has maintained his innocence by claiming the FBI and U.S. Attorney's Office are retaliating against him for refusing to cooperate in a criminal investigation of his doctor.

Chief Tallman said an internal investigation is under way and the officer's suspension is based on the federal criminal complaint and a violation of the department's code of ethics.

During his meeting with the chief, the officer, who was accompanied by his attorney, declined to answer questions. Chief Tallman said Officer DeWitt never has been disciplined while with the department.
