Ex-top cop cleared of ethics c

MAHWAH -- Councilman and former Police Chief Samuel Alderisio has been cleared of ethics charges lodged by a fellow council member.

Councilman Allan Kidd filed a complaint in October with the state Department of Community Affairs, alleging that Alderisio's involvement in closed-door talks or votes about police issues was a conflict of interest.


The DCA's Local Finance Board found that Alderisio did not violate four ethics provisions by using a police gym, voting on plans to upgrade police headquarters and participating in sick leave and PBA contract discussions. The board made the decision at its Aug. 8 meeting and Alderisio and Kidd were notified Thursday by a letter.

"I'm certainly pleased," Alderisio said Monday. "I didn't think that I did anything wrong.

"I'm glad it's finally over with and we can maybe move on and worry about council business rather than attacking each other."

Kidd called the findings "absurd." He questioned the board's acceptance that Alderisio is a "retired" PBA member and instead asserted that he is a lifetime member.

"As we sit here today, Sam Alderisio is a PBA member," Kidd said. "You can't be on both sides of the fence at the same time and negotiate with good faith.

"That's called self-dealing," he said. "It's patently unethical."

The board, however, found that because Alderisio is retired, he will not benefit from current or future police contract negotiations. And the use of the police gym -- and its equipment, which was purchased by the PBA -- is a privilege that is extended to all department retirees.

As for the sick-leave discussions, the board found that several years had passed since Alderisio worked with the officers and "it is reasonable to expect that Alderisio was able to maintain his objectivity and independence of judgment," according to a letter the DCA sent to Kidd, Alderisio and the township clerk, detailing the findings of the investigation.

Alderisio retired in 2000 after 38 years with the Police Department.
