Three ex-cops to face court ov

THREE former police detectives will fight assault charges and charges they lied to the Office of Police Integrity at two separate court hearings next year.

Melbourne Magistrates' Court heard yesterday that Mark Harrison Butterfield, 38, Robert Lachlan Dabb, 35, and Matthew Adrian Franc, 37, will contest charges stemming from an alleged assault on an armed robbery suspect in May last year.

The court was told the three men -- once members of the disbanded armed offenders squad -- will also contest charges that they knowingly made false statements in relation to evidence they gave at Office of Police Integrity hearings.

The two sets of allegations will be heard at two 10-day hearings starting on February 25 and April 28 next year.

Prosecutor Vivianne Morkos told the court there would be 18 witnesses giving evidence in relation to the alleged assault, while 17 witnesses would give evidence at the subsequent hearing.

Ms Morkos said there would be three police witnesses for the prosecution, with the remainder being civilian witnesses.

She said the prosecution wanted one witness to give evidence via video link.

Defence lawyer Tony Hargraves told the court the policemen would challenge the validity of an OPI warrant to record the defendants.

During its investigation, the OPI bugged an armed offenders squad interview room and filmed the alleged assault.

Yesterday the prosecution also withdrew assault charges against a fourth policeman, the former squad head Det-Insp Bernard Rankin.

Det-Insp Rankin had been accused of counselling and procuring the alleged bashing.

Magistrate Susan Wakeling ordered that the charges be struck out and that the Office of Police Integrity pay Det-Insp Rankin's legal costs.

Outside court Det-Insp Rankin said he was pleased with his outcome.

"It's been a fairly difficult matter for me," he said.

Police Association Victorian secretary Sen-Sgt Paul Mullett said Det-Insp Rankin's reputation and credibility remained totally intact.

Mr Butterfield, Mr Franc and Mr Dabb -- who was not in court yesterday -- face a total of 41 charges including multiple counts of unlawful assault and wilfully making a false statement.

The men have resigned from Victoria Police.

They will face Melbourne Magistrates' Court again on January 29 for a special hearing to determine whether a prosecution witness can give evidence via video link.
