Ethics Commission rules on Fol

The Alabama Ethics Commission voted 4-0 on Wednesday to issue a resolution regarding former acting Foley Police Chief David White, who admitted he earned $290 from an outside employer while he was on duty for the city.

Once the administrative resolution is approved by the Baldwin County District Attorney's Office, the commission can fine White up to $1,000 at a future meeting. The next meeting is scheduled for February.

The administrative resolution allows a person to admit a minor violation of the law and to pay restitution, said Jim Sumner, director of the ethics commission. White repaid the $290, Sumner said.

White is the chief investigator for the Foley Police Department and was the acting chief from March 2006 until January while the city searched for a new chief.

White said by phone Wednesday that he would not "answer a bunch of questions," but said he made a mistake and apologized for it.

"I'm held to a higher standard being a law enforcement officer than the citizens," he said. "I hope that this doesn't affect the trust that this city and the citizens have in me. I simply made a mistake and I'm paying for it."

Foley Police Chief David Wilson said he asked for the ethics commission to investigate the situation after White's outside work was discovered during an examination of the police department by an outside consultant.

White is a salaried employee who was found to have worked four days of off-duty employment at Shelton Fireworks in Loxley "during what should have been his normal regular police working hours," Wilson said.

"Lieutenant White cooperated with this inquiry and admitted he had been working some long hours at work during that time as acting chief and also worked some of those hours at the fireworks stand," the chief said.

Wilson praised White's work as a "critical member" of his command staff and commended his cooperation with the investigation.

"He realized that was a mistake and I personally do not think that is something that will happen again," Wilson said. "He is remorseful in it. He has paid back that money."

Wilson said the lieutenant will also face internal disciplinary action, but said that is a personnel issue and declined to be more specific.

There was minimal public discussion of the case by the commissioners.
