Police to probe drunk breath t

THE Queensland Police Service's ethical standards command has launched an investigation into an officer who performed a breath test after himself drinking 18 beers.

Police Commissioner Bob Atkinson ordered the probe after revelations in the The Courier-Mail newspaper.

A police spokesman said the investigation had today been elevated from a review by a district officer and assistant commissioner to an ethical standards command probe.

Police officers also face tighter restrictions on drinking off-duty in the wake of the incident.

"I am concerned at claims that a police officer who had been drinking was called back on duty to conduct a breath test,'' Police Minister Judy Spence said.

"That's obviously unacceptable and the commissioner is formulating a policy now to clearly state to officers that if they are under the influence themselves, then they should be not undertaking breath tests.''

The officer, who was stationed in Cunnamulla in Queensland's south-west at the time, drank 18 mid-strength beers while off-duty on May 14, 2005.

Later that day, he was called upon to perform a breath test on another man.

Later in the evening, the officer again put himself on duty to perform an arrest at a local hotel, before he was assaulted.

The officer is now a detective in Cairns.

Queensland Police Union president Cameron Pope today said the officer had no case to answer.

"I can't see why anything should happen,'' Mr Pope told ABC Radio.

"This was an officer who was subject to the conditions of being out west with minimum staffing levels, he was required to do something, he performed it without any complaint from any person, and was then brutally assaulted without provocation in a hotel by a large number of persons. I don't see what he's got to answer for.''

The officer was entitled to do what he liked on his day off, Mr Pope said.

"He was not on any rostered duty that day,'' he said.

"He was subject to be called back to duty, which he wasn't aware of at the time. He was on a day off and quite entitled to do whatever every other member of the public wants to do on their days off.''
Ms Spence said she did not want a repeat of the incident.
