In a case that could affect the way the San Francisco Police Department handles domestic violence calls, the Police Commission is investigating two members of the department for failing to follow procedures in responding to a rape call.

The Office of Citizen Complaints has charged Sgt. Ricardo Galande and Officer Jerry King with neglect of duty for allegedly failing to conduct a proper investigation of a rape and domestic abuse case in 2005. The commission assigned individual commissioners to investigate the allegations during its weekly meeting in City Hall on Wednesday.

City settles suit with cop

Capt. Harry Mendoza, the New Orleans police officer who regained his job after a Civil Service Commission ruling, won another round against the police department on Tuesday.

The city agreed to settle a lawsuit by Mendoza who alleged the department's Public Integrity Bureau conducted a politicized and, at times, illegal investigation into his activities.

Mendoza, a 30-year police veteran, was fired for allegedly spending his working hours at home and in the gym. The Civil Service reinstated him, saying the investigation was flawed.

On Tuesday, a federal judge, citing a firm agreement by all parties, dismissed Mendoza's suit against the department.

The case has cost the police department at least $200,000, including $100,000 in back pay and a $100,000 settlement of the suit.
