Israel: Police force to 'lawye

A decade after shutting down its unit of defense attorneys, the Israel Police has decided to revive it in an effort to improve police officers' performance by making them feel they have the organization's full backing.

"Police officers are sent out into the streets, which are a dangerous place," explained Brig. Gen. Shaul Gordon, legal advisor to the force. "If a policeman knows that any time he goes out on operational activity and is subject to a complaint he'll have to cope with it without comprehensive assistance, he simply won't dare to do his job. In such a situation, we'll get a weak police force and policemen who fear to lift a finger."


The attorneys will provide legal aid to officers who face either disciplinary proceedings or investigation by the Justice Ministry department that probes police misconduct. Officers will be able to consult the attorneys even if they are investigated for a crime unrelated to performance of their duties. The goal is to provide services similar to those given soldiers by army defense attorneys.

Currently, officers under investigation must appeal to a special committee headed by Deputy Police Commissioner Ilan Franco for legal assistance. If the aid is approved it is provided by an attorney from the government insurance company Inbal. If the officer chooses to use a private lawyer instead the force covers a portion of the legal fees.

Under the new system, all police officers will be entitled to consult a police defense attorney. Those whose applications are approved by the committee will be able to choose between the police attorney and the Inbal attorney.

An internal committee headed by Franco recommended reviving the unit after studying the idea for several months. The decision still needs formal approval by the police command and attorney general, but a senior police source predicted the first defense attorney would be on the job within two months.
