India: Cops prosecuting whistleblowers; beneficiaries let off hook: Kulkarni

Sudheendra Kulkarni, a former BJP ideologue and whistleblower in the 2008 cash-
for-vote scam, on Saturday raised doubts over the police investigation, asking
why beneficiaries from UPA-1 had not been quizzed yet.

Questioning the Delhi Police integrity, and seeking bail for Kulkarni, his counsel
Mahipal Singh said, “Who is the actual beneficiary? This is a million dollar question
for them (prosecution) but they do not have any answer. It was not Rajya Sabha
member Amar Singh’s Government which was to be saved. The actual beneficiary
was the then (UPA-I) Government. None of the persons from that Government has
even been interrogated. It (the money) has come from actual beneficiary and
routed via Amar Singh. The source of money has not yet been interrogated.”

The court also decided to watch on Monday all six CDs containing footage of the
purported sting operation conducted in the run-up to the July 2008 voting in the Lok
Sabha on the trust motion by Congress-led UPA Government.

The defence counsel contended before Special Judge Sangita Dhingra Sehgal that
there was not even an iota of evidence that Kulkarni solicited anything in lieu of
money.

Kulkarni claimed he was ‘a whistleblower’ who intended to expose corruption. He
added that Rajdeep Sardesai, editor-in-chief of CNN-IBN, the channel which
conducted the sting, too knew everything about the operation.

Kulkarni’s counsel said, “CNN-IBN did not inform the authorities either. So, if they
have been made a witness, I (Kulkarni) should be made a witness, too.”

The Delhi Police strongly opposed the bail pleas of Kulkarni and two former BJP
MPs Faggan Singh Kulaste and Mahavir Singh Bhagora, and rejected their claim of
being whistleblowers in the scam. “Every accused in the case terms himself as a
whistleblower as if they have saved the country. If they are taking the plea of
being whistleblowers in the scam, they have to establish it by way of evidence,”
said public prosecutor Rajiv Mohan.

Opposing their bail pleas, the public prosecutor said the accused had received Rs
1 crore as illegal gratification at around 11 am on July 22, 2008, and they retained
the bribe money for five hours. Mohan said, “AB Bardhan, general secretary of
Communist Party of India (CPI), had claimed to have possessed a list of MPs
allegedly being bribed during the trust vote and said their rate was Rs 25 crore but
the accused MPs preferred to contact co-accused Sohail Hindustani and not
Bardhan, an honest person. Hindustani himself was trying to make money by way
of commission from the list.”

Mohan pointed out, “There was no talk of sting operation on July 20, 2008. Despite
this Hindustani had a list of vulnerable MPs, including the names of the three BJP
MPs. It proves the conspiracy had already been hatched among the accused.”
Turning down allegations that the police had not probed the role of various
persons in Congress, alleged beneficiary of the scam, Mohan said the UPA-I
Government had secured 275 votes in the trust motion. He added, “They (UPA-I)
would have been the beneficiary had the three votes counted. It made no
difference to them. The beneficiaries were the accused who tried to make money
during the trust vote.”

The prosecution added that if their intention was to expose the horse trading,
allegedly going on at the time of trust vote, they should have waved the money
while coming out of Amar Singh’s house where the media was present.

Meanwhile, the judge also asked Delhi Police to submit all the case-related CDs
which it has in its possession. The court also directed the prosecution to get an
expert to play the CDs in the courtroom after Kulkarni’s counsel alleged the CDs
submitted by Delhi Police were incomplete. “If you have sent all the six CDs to the
FSL (forensic science laboratory), that means you have something in mind
otherwise you could throw it in dustbin. Let us be fair to all. Whatever you have
(CDs), you produce it before the court and show it to all,” the judge said.
