Portland police officer indict

A Multnomah County grand jury Tuesday indicted Portland Police Officer Jason Faulk on two counts of official misconduct stemming from allegations that he had sex with a woman twice while he was on duty.

The jury, which heard testimony over three days, voted not to file any sexual abuse charges against the 33-year-old officer.

A key factor in the grand jury's deliberations rested on whether the woman, described as autistic and emotionally challenged, was capable of consenting to the sex or is considered mentally incapacitated. The grand jury considered the charge of second-degree sexual abuse, which occurs when someone subjects another person to sex without consent.

"I believe they found she was able to consent, and did so,'' Multnomah County Deputy District Attorney Chris Mascal said.

Among those testifying to the woman's mental health were experts from Cascadia Behavioral Healthcare and Multnomah County's Developmental Disabilities Office.

Faulk, a Central Precinct night shift officer who was placed on paid leave Sept. 11 after the woman filed a complaint with police, already has pleaded not guilty to two counts of official misconduct, charges that the district attorney's office filed before the grand jury had heard all testimony. The district attorney's office went ahead with charges because prosecutors wanted Faulk under court supervision. The court ordered he possess no firearms, have no contact with the woman, allow his home to be searched and undergo continual mental health care.

The officer is expected to be arraigned on the indictment sometime next week.

The woman said she met Faulk when he responded to her home after she had called police to report suspected mistreatment involving her 7-year-old son.She said Faulk returned that night to her home to give her his written report, and came back several times while he was on duty. Aside from having sex in her home while he was on duty on or about July 25 and Aug. 16, the woman also alleges that Faulk went with her to a 24-hour Walgreens pharmacy after their second sexual encounter and helped her buy a morning-after pill. Investigators pulled the video surveillance images from the store.
