Ministers to face suits for ab

Kenya National Commission of Human Rights (KNCHR) wants seven Cabinet ministers charged for alleged misuse of public resources.

Also in the "list of shame" are a host of assistant ministers, MPs and councillors who have been accused of using public resources in the ‘No’ and ‘Yes’ campaigns.

The list by KNCHR and Kenya Human Rights Commission has been forwarded to the Attorney General Amos Wako for action.

"If he does not charge them, we would institute private prosecution. We have charged two people," Maina Kiai, chairman of KNCHR, said.

Those in the list are accused of using government vehicles to conduct the referendum campaigns in contravention of the Public Officer Ethics Act of 2003, Maina says.

Ministers in the list are Ochillo Ayacko, Kiraitu Murungi, Simeon Nyachae, Joseph Munyao, Amos Kimunya, Martha Karua and William ole Ntimama.

Assistant ministers in the list released yesterday are Andrew Ligale, Mwangi Kiunjuri, Peter Odoyo, Wilfred Machage, Kivutha Kibwana, Mirugi Kariuki and Beth Mugo.

MPs in the list are Godfrey Gitahi Kariuki, Mohamed Abdi Mohamed, Koigi Wamwere and councillors from various local authorities.

Releasing the list, Kiai said if the AG does not act within the next few days, they would institute private prosecution.

"Kenyans do not pay heavy taxes to the Government for the officials attend campaign rallies using their money," Kiai said.

He said another list of shame on leaders who have incited wananchi to violence, used hate speech bent on creating ethnic hate and distortion of the contents of the draft will be released soon.

Kenya Human Rights Commission represented by Steve Ouma, the Deputy Executive Director at the occasion, co-wrote the report.

He said the Public Officer Ethics Act of 2003 provides in Section 15 that, all public officers, including ministers, should ensure that property entrusted to them is not misused.

Ouma said the law forbids ministers from participating in the referendum campaigns in their capacity as ministers.

He said the campaigns are not official government business.

Kiai said some politicians used vehicles suspected to be government cars but bearing private registration numbers.

Catherine Mumma, a commissioner with KNCHR, condemned the use of police and military helicopters to conduct the campaigns.

She said the Chief of Staff should not allow military aircrafts to be used in partisan campaigns.
