Stoughton cop sues 3 fellow of

A Stoughton police officer is suing three fellow officers claiming they damaged his reputation with false statements about professional misconduct in 2004 while the department was in turmoil.

Lt. Michael Blount claims the defendants, Detective Sgt. Daniel McGowan and officers Lino Azul and John Owens, falsely accused him of “criminal misdeeds” that caused him emotional pain and suffering.

Blount, a Canton resident, filed the suit in late February in Norfolk Superior Court in Dedham and it was served to the defendants on April 30. It seeks both punitive and monetary damages in excess of $100,000 for defamation of character. Blount is seeking a jury trial.

The suit states that in the summer of 2004, the Norfolk County district attorney began an investigation into misconduct by seven Stoughton police officers, including the defendants and former Police Chief Manuel J. Cachopa.

Blount was assigned as the department’s lead investigator in the matter. His investigation resulted in a grand jury proceeding that named the seven police officers.

The seven officers, including Cachopa, were placed on administrative leave during the grand jury proceedings, but were returned to duty in November 2004 after a change in the makeup of the Board of Selectmen.

Blount’s suit says that when they returned to duty, the officers named in the suit began spying on Blount, including trying to videotape his cruiser to prove police misconduct.

The officers turned the tape over to the town, which refused to take action against Blount.

Despite that, the suit says in 2006 McGowan, Azul and Owens sent DVDs of their videotapes again to the town of Stoughton through the acting police chief and town manager.

“However, this time they also sent copies of the DVDs to the Stoughton Board of Selectmen, the Brockton Enterprise of Brockton and Fox television along with a note complaining that Blount had engaged in ‘criminal misdeeds,’” the suit states.

The note sent with the DVDs contained “defamatory, false and malicious statements relating to alleged misconduct” on Blount’s part, the suit says. It says that the statements have resulted in damage to Blount’s reputation and cost him promotions, mental and emotional pain, and humiliation.

In March 2005, three of the seven officers, Cachopa, former Sgt. David M. Cohen and officer Robert E. Letendre, were indicted on criminal misconduct charges. Letendre was acquitted of all charges and reinstated to the department at full rank and salary.
